Now, in using his own words ...

Neither the NCAA, an athletic conference, nor any other organization with authority over intercollegiate athletics shall take any adverse action against a postsecondary educational institution in the State of Georgia for such institution facilitating compensation, offering compensation, or compensating an intercollegiate student-athlete for the use of such student-athlete's NIL.

If the NCAA were to actually do their job, and definitively articulate precisely what NIL is, then Mr. Kemp here may have shot himself in the foot.

All they have to do, is say:

NIL is the Student-Athletes own marketability to afford the chances to monetize their self Name & Image. It is not a pay for play where the school itself, as an entity, maintains said Student-Athletes as employee/staff privileges, and, as such, are unimpeded by the NCAA, Conference or any other Organization with Authority over Collegiate Athletics to pursue, for oneself, without the Aid of any of the aforementioned bodies, a value for each individual Student-Athletes' Name, Image and Likeness as proper compensation.

Using language is easy. Counteracting a vernacular is easier, because you have the advantage of analysis & response.

Putting the right words into context, someone could easily deconstruct everything in Gov Kemp's "Executive Order". And because he put this Bill through, he'd be liable for the fallout when it blows up in his face.

It could, literally [in the very strictest definition], create exactly the opposite effect he was hoping for. Should the "Organizations With Authority Over Intercollegiate Athletics" categorize NIL in a detailed explicit model, then the Student-Athletes could find themselves on the outside looking in, so to speak.

The restriction of who is allowed to levy NIL fund, as opposed to how much and who receives them can be argued implicitly.

Honestly, this was truly a dumb move.

The University of Tennessee is adding a 10% Football Ticket Sales Increase, wherein the extra 10% gained will go directly to the Volunteers Athletics NIL fund.

Now, if I'm a visiting team fan, I say, "Nope!"

I'm not giving money to another schools NIL fund, to outperform my team's NIL revenue accumulations.

Honestly, if this were a simple optional upcharge, that you could choose yes or no, I would not have a problem with this.

However, because it's mandatory the all spectators will be levied this fee, I feel this is a mere passing of the buck down to the fans, in order to forego the Athletics Department's own obligation to fulfill their agreements with student athletes.

If I'm paying the NIL bill to these kids, then I want a say in how much each one of them is going to receive. Otherwise, sell the seat to some other moron who doesn't know the difference.

In that case, I want a say in which players we go out and procure. Whether that be from recruiting, or the transfer portal. Because you just made me an unintended venture partner.

Go figure, UT Director of Athletics Danny White, who claimed UCF's Football National Championship when he was the Knight's Athletics Dirctor, would come up with something like this.

They are certainly ‘inflating’ more than the footballs down in Knoxville……… probably the ‘Texas Effect’.

As I understand it, Tennessee Football Tickets will raise 4.5% in addition to the $10 bucks For the ‘Talent Fee’.

Curious as to why the AD didn’t mention any ‘Cost Cutting Measures’…..

The only thing I would watch out for now, is the ever increasing concession sales, and how much of that, exactly, is related to NIL fees.
